Failure of Special Prosecutor, attorney-at-law, Sanjeev Datadin to attend court, has resulted in a wrongful confinement charge being dismissed against three New Building Society (NBS) managers, who were accused of locking customers inside of the establishment last year.

The matter was once again set for hearing this afternoon before Senior Magistrate Dylon Bess at the Georgetown Magistrate’s Courts.

However, Datadin was a no show. His name was summoned thrice by the Court orderly, but no one appeared or answered to the name.

This led to the Magistrate inquiring from his clerk as to whether Datadin sent a letter informing the Court of his absence. The clerk confirmed that no such letter was sent.

The Magistrate dismissed the case against the managers on the basis of want of prosecution.

Charged were Anil Kishun, CEO of NBS Anil Beharry and Deka Tularam. They all denied the eight charges, which alleged that on January 23, 2018 last, at the Avenue of the Republic building, they wrongfully confined Ganesh Kalicharan, Goodish Singh, Alex Moore, Joseph Allen, Gina Arjoon, Patrick Higgins, Martin Brown and Ganish Hira, from proceeding out of the building.

It was reported that marshals had moved to levy on NBS assets in a $59M judgment in favour of its former Chief Executive Officer, Maurice Arjoon.

However, on the day in question, the bank closed its doors locking inside several customers, a Court Marshal, a lawyer and a police rank, after a team of Court Marshals went to NBS to levy on its assets in a $59M judgment for its former CEO Maurice Arjoon.

Arjoon and two others were charged in 2007 in a high-profile case for allegedly stealing $69M from the mortgage entity.

After years of battle in the High Court for his outstanding pension and benefits, Arjoon was awarded $79M by Justice Brassington Reynolds.

However, Justice Rishi Persaud, reduced the $79M to $59M.

After a five-hour standoff, NBS was forced to hand over a cheque to Arjoon’s wife, Gina, in the sum of $59,033,281.
