As a result of its failure to comply with the schedule of works for the modernization of the Yarrowkabra Secondary School on the Linden Highway, Attorney General and Minister of Legal Affairs, Anil Nandlall, by way of a letter, informed BK International Inc., that the said contract has been terminated with immediate effect.
In the November 1, 2020, missive seen by Guyana Standard, Nandlall noted that the APNU+AFC regime entered into a contract through the Ministry of Education with BK International on December 31, 2019, for the construction of the school. The contract totaled $826.7M and was scheduled to be completed on March 12, 2021.
Nandlall pointed out that thus far, only five percent of the works have been completed. As a consequence, the Attorney General said that the company has committed a fundamental breach of the terms of the contract by failing to comply with the schedule of works which would inevitably result in inordinate delays.
The Minister of Legal Affairs said that government will impose the provisions in the contract regarding the enforcement of 10 percent of the contract sum as liquidated damages and the surrendering of the performance security as a consequence of the company’s violations.
Nandlall noted as well that the government reserves the right to institute legal proceedings against the company for compensation of breach of contract. Nandlall also instructed BK International to arrange to have the site cleared immediately.
